Miller was photographing police officers at a construction zone in February 2007 when he was ordered to “keep walking” by the police. When he refused, stating that the road was a public one, the police tackled Miller towards the ground bashing his head and smashing his camera flash in the process.

Following this Miller then spent 16 hours in the county jail on nine counts of misdemeanor including the obstruction of traffic, even though Miller claims he was not actually standing in the road.

Now the photographer has been found guilty of resisting arrest despite pleading otherwise on all counts. His sentence includes one year probation, 100 hours of community service and anger management classes as well as having to pay $540.50 in court costs.

"I don't see the case has being a total loss as I was found not guilty of disobeying a police officer or of disorderly conduct", says Miller. "The verdict is still unfair however and I am planning to appeal."
