Hornets are not a protected species - in fact no bee or wasp species is protected by law in this country.
The species is quite plentiful within its range (see BWARS Home Page for a map), but secretive. They are generally docile. The insects they prey on are for feeding the developing brood. The adults are nectar/sap feeders
Hmmm did some searching around on the protection status and it seems its a mixed message - I know we were told by the council that they were a protected species so I wonder if they've worked their way onto some council protection list without being listed on any "official" protection listings. Unless they are a delisted protected species and some councils have just not updated their listings.
edit - surprised bees aren't on the list considering the recent major problems with the disease spread that has wiped out a lot of bee colonies last year

I`ve seen quite a few today, this time not indoors, they where doing a pretty good job of sorting out my wasp problem ![]()
Lol thought this quite interesting.
