Chipping Sparrow most likely. These rufous topped sparrows are so difficult to identify accurately. Very similar to Rufous Crowned but this one has black just above the beak center. A quiet and secretive bird, yet he was curious. I think it's my blue plaid shirt.

You should try a noise reduction software such as Noise Ninja Tony, it would really improve whats already a nice shot. The later versions of Photoshop CS do a decent job also.
