Does anyone know how the law goes as to photagraphing the public and what is around us?

For instance whilst in melbourne recently i was selling photography of all the grafiti murals and it was going down a storm, one of the mural artists came to myself and asked if what i was doing was legal as he thought i was stealing artwork. I looked into the issue and in OZ there is a bill of rights mentioning that what is visible to the eye is in the public domain and therefore you are allowed to capture it. Please help.

There are lots of threads about this recently.

Not wanting to repeat them all, but I'm 99.999% sure that your understanding of Oz law will not be right. There'll be a rule very roughly equivalent to the UK rules - ie. that copyright in an artwork is not infringed if its inclusion in the image is only incidental. If you were selling photographs where someone else's artwork was a key part of it, then the mural artist was right - you were breaching his copyright.

How would the copyright law go if had not placed a tag claiming his right?

You don't need to sign something to claim copyright - of course it would have been interesting to have invited him to take it further in court.

What Im worried about is the potential IP infringement from your screename and mine esp when you seem to operate in the same industry ...

Maybe I should have a word with the solicitor tomorrow ??
